1. General Conditions

  • Eligibility: You must be at least 18 years old or have parental consent to purchase from this shop.

  • Agreement: Using this site means you accept these terms completely.

2. Art Orders and Payment

  • Order Acceptance: All orders placed through the website are subject to acceptance. We may refuse or cancel an order at our discretion due to limited stock, errors in pricing, or suspected fraud. [1]

  • Pricing: All prices are listed in USD (or your local currency) and do not include shipping fees or taxes, which are calculated at checkout. [1]

  • Payment Methods: Payment must be made in full at the time of ordering via our secure authorized payment processors, except where milestone payments are agreed upon for commissions.

3. Custom Art Commissions

  • Commission Agreement: Custom or commissioned projects require a separate, signed brief or electronic agreement outlining the scope, design timeline, and pricing. [1]

  • Non-Refundable Deposit: All custom commissions require an upfront, non-refundable deposit (typically 50% of the total quote) before any project work or sketching begins.

  • Approval Process: Digital drafts or progress photos will be provided for your review. Once you grant final approval on a piece, no further major changes will be made.

  • Cancellation: If you cancel a commission after work has begun, your upfront deposit is forfeited to cover time and materials.

  • Final Payment: The remaining balance must be paid in full before the finished custom piece is packed or shipped. [1]

4. Shipping and Delivery

  • Fulfillment: We process and ship ready-made artwork within our standard handling timelines. Custom or commissioned pieces require extra production time as outlined in your project brief.

  • Risk of Loss: The ownership and risk of damage to the artwork pass to you, the buyer, the moment we deliver the package to the shipping carrier.

  • International Orders: Buyers are solely responsible for any customs duties, import taxes, or brokerage fees levied by their destination country.

5. Returns, Refunds, and Damages

  • Inspection: You must inspect the artwork immediately upon arrival.

  • Damaged Shipments: If your art arrives damaged, you must contact us with photographic proof of the art and packaging within 48 hours of delivery to qualify for a replacement or refund.

  • Return Policy: Standard sales are final unless otherwise stated. Custom commissions are 100% non-refundable and cannot be returned due to their personalized nature. [1]

6. Intellectual Property and Copyright

  • Artist Retention: Dominic Costello Art retains all legal copyrights to all artwork—including custom commissions—including all reproduction rights.

  • Usage Restrictions: The purchase of a physical or digital artwork does not transfer any copyright or commercial reproduction rights to the buyer.

  • No Resale of Rights: You may not copy, print, modify, distribute, or digitally reproduce the artwork for commercial purposes without explicit, written permission from the artist. [1, 2]

7. Limitation of Liability

  • Platform Use: We are not liable for any direct or indirect damages resulting from your use of this website.

  • Art Display: We try our best to display colors accurately. However, actual colors may vary slightly depending on your monitor settings.
